Our Policy Statement

This Privacy Policy (“Policy”) explains how The Young Group (ACN 610 926 942), our related companies and trusts (“TYG“, “we”, “our” or “us”) collect, store, use, disclose and manage your personal information.

The Privacy Act 1988 (Cth) (‘the Act’) requires entities such as this one, The Young Group (‘TYG’) to have a privacy policy. This Privacy Policy outlines the personal information handling practices of TYG. This Policy is written in simple language. The specific legal obligations of TYG when collecting and handling your personal information are outlined in the Act and in the Australian Privacy Principles in that Act.

Purpose

The Young Group is a diversified property group and our key business activities include:

  • property development;
  • property construction;
  • equipment hire;
  • investment in and leasing of properties we develop and construct;
  • investment in, operation and leasing of industrial communities;
  • investment in, operation and leasing of commercial communities;
  • investment in, operation and leasing of residential communities;
  • body corporate and facility management;
  • real estate agency services; and
  • funds management including in relation to unlisted property funds.

By providing personal information to us, you consent to our collection, use, storage, disclosure, and management of your personal information in accordance with the Privacy Act 1988 (Cth) (“Privacy Act“) and this Policy.

What personal information do we collect?

At all times we try to only collect the information we need for the function or activity we are carrying out.

Personal information is defined as information or an opinion that can identify or can reasonably identify an individual. This may include an individual’s name, address, email address and telephone numbers. The type of personal information that TYG collects will depend upon what dealings the relevant individual may have with TYG.

TYG may collect and hold personal information about individuals who:

  • purchase, or express an interest to purchase, from TYG (for example, when entering into a sale and purchase agreement, or when responding to requests for information about a YG property)
  • register or subscribe for electronic newsletters (either in person or online) customer loyalty programs, competitions or promotions run by TYG;
  • hire equipment from TYG or one of our associated entities;
  • enter a property managed by TYG, building or car park (for example, our camera surveillance systems (commonly referred to as CCTV) may collect footage or still images of individuals and vehicles as well as licence plate details for security purposes or at some TYG managed buildings, visitors are required to register before entry for building safety purposes);
  • use mobile applications developed by TYG or logon to wireless facilities provided in a YG managed building or centre;
  • lease, or express an interest to lease, premises, or spaces, including any related guarantors (for example, when negotiating, entering into or applying to enter into a lease with TYG).
  • seek employment with TYG or are TYG employees (for example, when conducting background checks for the purposes of employment);
  • supply goods and services (for example, when establishing records and systems to enable payment for goods).
  • use TYG’s websites, social media and other online services;
  • may otherwise come into contact with TYG; or
  • are provided loans or other financial accommodation by TYG.

Further, TYG may collect information from you because we are required or authorised by an Australian law, or Court or tribunal to collect that information.

Security of information

TYG will take reasonable steps to protect personal information that it holds from unauthorised access, modification, misuse, interference, and loss. TYG maintains physical security measures over its physical premises, and a range of computer and network security measures (such as systems access, firewalls, data encryption) over its electronic systems. TYG employees are required to maintain the confidentiality of any personal information held.

If other parties provide support services, TYG generally requires them to agree to appropriately protect the privacy of the information provided to them.

Use and disclosure of personal information

TYG operates several businesses which handle personal information. TYG’s policy is only to use personal information for the purpose which was either specified or reasonably apparent at the time when the information was collected. TYG may also use or disclose the information collected for any other related purpose for which the individual would reasonably expect it to be used.

If TYG wishes to use or disclose the personal information in other circumstances, it needs to obtain the individual’s consent to do so.

We may collect, hold, use and disclose your personal information for the following purposes:

  • providing products or services that have been requested;
  • to do business with you;
  • communicating with the individual;
  • assessing the suitability of prospective tenants;
  • helping TYG manage and enhance its products and services, including analysing customer feedback and future customer needs;
  • providing ongoing information and marketing about products and services to individuals that TYG believes may be interested and where the individual has signed up;
  • to investigate incidents (including potential incidents) which occur on or at our premises;
  • for security and safety and risk management purposes;
  • complying with regulatory and legal obligations;
  • recruiting employees and contractors; or
  • fulfilling its obligations to employees.

We will not use or disclose your personal information for any purpose other than the purpose for which it was collected (or a related purpose) unless you have consented to that purpose, or we are permitted to do so by law.

When is your information disclosed?

We may disclose your personal information (including in some circumstances, your sensitive information) for the purposes for which it was collected or related purposes (as described above) to:

  • affiliate traders in centres;
  • social media channels on which we have a presence such as Facebook, Twitter and Instagram, generally in these cases we limit disclosure of your personal information to your first name and surname;
  • regulatory authorities, police or government agencies or bodies where required by law;
  • related parties, entities, and trusts of TYG; and
  • other companies, service providers and individuals who assist us in providing our services or managing our operations.

If any YG entity is sold to a third party, we may transfer any personal information we hold about you to that third party. We may also disclose personal information on a confidential basis to prospective purchasers of a YG entity.

Where we have disclosed personal information to a third party acting on our behalf, we request that those third parties do not use the personal information for their own purposes and that they comply with the Privacy Act and this Policy.

TYG does not sell personal information to entities outside the TYG Group.

CCTV

We use CCTV surveillance systems to monitor and record activities at TYG properties and premises (including our workplace and other locations such as finished projects and projects under completion), the main purpose of this is to maintain a safe and secure environment for our employees, customers and visitors to our premises.

This means we may use your personal information gathered from CCTV for security and risk management, loss prevention, incident investigation purposes and other purposes set out in this Policy, or as permitted by the law.

We also use the data collected from our CCTV surveillance systems to maintain or improve our properties, premises and services, we may do this by:

  • collecting and analysing customer behaviour;
  • monitoring patterns of foot traffic; and
  • analysing shopper demographics and browsing habits.

When used for these purposes the data is aggregated anonymously. We do not identify individuals for these uses.

We securely discard the data collected from our CCTV surveillance systems when it is no longer required for business or legal purposes.

Free wi-fi service

We offer a free Wi-Fi network service at certain YG premises.

If you are carrying a Wi-Fi enabled device within range of one of our Wi-Fi networks, we may pick up certain data that is transmitted from your device whether you join our Wi-Fi network, including:

  • your device ID, device type, IP address and MAC address;
  • geo-location information and any movement of your device throughout our premises;
  • any other information which you may voluntarily provide to us while accessing our Wi-Fi networks, for example, your name, email address, the details of the websites or mobile applications whilst you are connected to our network;

We may also link this type of information to your provided personal information if we hold a common identifier such as your unique device identifier.

In each case, we will only use information or data collected via our free Wi-Fi network service in accordance with, and for the purposes set out in this Policy, or as permitted by the law.

If you do not want this information collected, you can disable Wi-Fi and Bluetooth on your device/should not sign into the Wi-Fi network.

Cookies

Cookies are data files placed on a Device when it is used to visit our websites. We may place cookies or similar files on your Device for security purposes, to facilitate site navigation and to personalise your experience while visiting our websites. Cookies allow us to collect technical and navigational information, such as browser preferences. However, please be aware that some features of our websites may not function properly or may be slower if you refuse cookies.

Marketing

TYG may send marketing materials to its customers or potential customers where TYG has collected the personal information from the individual and the individual would reasonably expect TYG to use the information for that purpose.

The individual’s prior consent will be obtained before personal information is used for marketing purposes in situations where the personal information has been collected from the individual and the individual would not reasonably expect TYG to use the information for that purpose, the personal information has not been collected directly from the individual or where sensitive information is involved.

If the customer no longer wishes TYG to use his or her personal information for TYG to provide marketing materials, the customer is to advise TYG via the relevant method provided for in the electronic marketing message sent to the customer (e.g., via an ‘unsubscribe’ link) or to write to the TYG (refer to contact details below). TYG will act and amend its records promptly.

Access to your personal information

Any individual can request access to the personal information TYG may hold about them. To obtain access to the information, the individual needs to write to the TYG (refer to contact details below). TYG will require evidence to verify the identity of the individual.

This service is free of charge unless the personal information requested requires preparation time. In this situation, TYG will provide an estimate of how much this service will cost and request agreement before proceeding.

In normal circumstances, TYG will provide the individual with access to the individual’s personal information. However, in some circumstances, there may be legal, regulatory, or administrative reasons to deny the requested access. If access is denied, TYG will provide the individual with the reasons for doing so.

Changing personal information

If an individual wishes to change personal information that the individual believes may be inaccurate, out-of-date, incomplete, irrelevant, or misleading, the individual may write to the TYG requesting the information to be changed.

If TYG disagrees with the individual that the personal information should be changed, TYG will provide the individual with the reasons for doing so. The individual has the right to request that a notation be included with their personal information to indicate their disagreement with their personal information held by TYG.

Complaints

An individual can make a complaint about the way in which The Young Group has handled an individual’s personal information by writing to us. The Young Group will endeavour to act promptly in response to a complaint.
